Types of Immigration Cases Where I-CARE Certified Polygraph Verification Is Being Used

Asylum
Asylum may be granted to an alien who is found to be unable or unwilling to return to his or her country of nationality, or to seek the protection of that country because of persecution or a well-founded fear of persecution. Persecution or the fear thereof must be based on the alien’s race, religion, nationality, membership in a particular social group, or political opinion. I-CARE Certified computerized polygraph exams verify the petitioner’s statements regarding their claimed experiences and occurrences of torture, abuse, persecution for being a member of a certain religious or political group.

Violence Against Women
The Violence Against Women Act permits an abused immigrant to file a visa petition on her own behalf if she or her children have been abused by her U.S. citizen or lawful permanent resident spouse. In addition, immigrants can use the Act defensively in deportation proceedings by requesting a suspension of proceedings if they or their children can produce credible evidence of battering or extreme cruelty. The immigrant must show that she or her children have been physically battered or subjected to extreme mental cruelty. I-CARE Certified computerized polygraph exams verify the petitioner’s statements regarding the duration and intensity of the physical and/or emotional abuse.

Adjustment of Status
Legal Immigration Family Equity Act allows persons who were qualified for permanent resident status but had immigration status violations to pay a penalty fee and apply for adjustment of status at an INS office. The Act also allows entry of spouses of U.S. citizens and permanent resident aliens who have had petitions for immigrant visas pending for three years or more. An adjustment to permanent resident status is afforded when the immigrant visa has been approved. I-CARE Certified computerized polygraph exams validate the petitioner’s needed elements in foundational briefs and argument.

Marriage Fraud
Immigration Marriage Fraud Amendments were passed in order to deter immigration-related marriage fraud. Its major provision stipulates that aliens deriving their immigrant status based on a marriage of less than two years are conditional immigrants. If the aliens cannot show that the marriage through which the status was obtained was and is a valid one, their conditional immigrant status may be terminated and they may become deportable. I-CARE Certified computerized polygraph exams verify whether the petitioner married for a fraudulent immigration benefit, and/or explores any abused immigrant spouse issues.

Terrorism
I-CARE Certified computerized polygraph exams verify petitioner’s denial about the government’s claim of their membership in, material or other support of a terrorist group(s) as it relates to their immigration status.

Human Trafficking
Victims of Trafficking and Violence Protection Act was enacted to combat trafficking in persons, especially into the sex trade, slavery, and involuntary servitude, and to help prevent violence against immigrant women and children. I-CARE Certified computerized polygraph exams verify the petitioner’s statements regarding their victimization and entry into the United States as victim of the sex trade, slavery, or otherwise involuntary servitude.
